In every state, abortion is legal in the second trimester. In many states, there is also no restriction in the third trimester. In states where there is, a legal loophole created in the Supreme Court Case Doe V. Bolton allows for third trimester abortions. In this court case, the court ruled that no state could regulate third trimester abortions that are for a woman's 'health.' However, the court went on to define health as "any physical, mental, or emotional condition including the women's age." It did not mention how it was to be determined that a woman has a 'health' condition. So, in any state, all an abortionist has to do is fill out paperwork stating that a woman's mental or emotional health is endangered by her pregnancy. No psychiatrist or outside doctor need be consulted. Therefore, third trimester abortions are legal and available in every state- as long as the proper paperwork is filed by the abortion provider and the woman says she needs the abortion.  Dr. Tiller, who makes his practice aborting late-term babies, performs many abortions in the third trimester even though there are restrictions on late-term abortions in his home state of Kansas.

Only one percentage point separates the pro-life opinion from a pro-choice opinion. The majority (over half) of all Americans think abortion is morally wrong.
